Terms of Service.

These Terms of Service (the “Terms”) form a legally binding agreement between you (“you”, “your”) and Mastersmith (“Mastersmith”, “we”, “us”, “our”), the operator of this website and the digital products, guides, templates, tools, and one-to-one sessions offered through it (collectively, the “Services”). If you do not agree to these Terms, do not use the Services.

1. Who we are and what we offer

Mastersmith provides educational and informational resources — including written guides, spreadsheets, templates, checklists, and optional paid one-to-one calls — intended to help you research, plan, and prepare your own graduate (master’s) school applications in your own voice. Mastersmith is not a university, an admissions body, a placement agency, an immigration or visa consultancy, a recruiter, or a licensed advisor of any kind.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Services. By using the Services you represent that you meet these requirements and that all information you provide is accurate and your own.

3. No guarantee of results — educational use only

This is important, so we are explicit: Mastersmith does not and cannot guarantee any outcome. We do not guarantee admission, offers, interviews, scholarships, funding, visas, grades, rankings, or any particular response from any institution or third party. Admissions decisions are made solely by the institutions concerned, based on their own criteria, and are entirely outside our control.

All content is provided for general educational and informational purposes only. It does not constitute professional, legal, immigration, financial, career, or academic advice, and must not be relied upon as a substitute for advice from a suitably qualified professional or from the official guidance published by the institutions to which you apply. You are solely responsible for verifying deadlines, requirements, eligibility, and the accuracy and integrity of everything you submit.

4. Academic integrity

Our tools are designed to help you produce authentic, self-written applications. You agree not to use the Services to misrepresent yourself, fabricate credentials, plagiarise, or otherwise breach the honour codes, terms, or policies of any institution or examination body. You are exclusively responsible for the content, honesty, and originality of your applications. Any consequences arising from misrepresentation or academic misconduct are yours alone.

5. Purchases, pricing, and payment

Prices are displayed on the site and may be shown in Indian Rupees (INR) or US Dollars (USD) depending on your selected region. Unless stated otherwise, you are charged in INR. Payments are processed by third-party payment providers, including Razorpay. We do not receive or store your full card or banking details. Your use of a payment provider is subject to that provider’s own terms and privacy policy. We may correct pricing errors, change prices, or withdraw products at any time before you purchase.

6. Digital products — delivery and no refunds

Paid products are digital goods delivered instantly or near-instantly by email and/or download link. By purchasing, you expressly consent to immediate delivery and acknowledge that, to the maximum extent permitted by law, all sales are final and non-refundable once the product has been delivered or the download link has been made available. Download or access links may expire (for example, after 24 hours); it is your responsibility to save your files. If a technical fault prevents delivery, contact us and we will make reasonable efforts to re-send your files.

7. One-to-one sessions

Paid calls (such as a “Power Hour” or “Statement Teardown”) are booked through a third-party scheduling provider (Calendly) and provide personal opinion and general guidance only. They are not professional advice and carry no guarantee of any outcome. Missed sessions, late arrivals, or no-shows may be forfeited. Rescheduling is subject to availability and any policy shown at the time of booking.

8. Intellectual property and licence

All Services, content, and materials are owned by or licensed to Mastersmith and are protected by intellectual-property laws. On purchase (or free download), we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable licence to use the materials for your own individual application process. You may not copy, resell, redistribute, sublicense, publish, share, or create derivative works from the materials, or use them commercially, without our prior written consent. We may revoke this licence if you breach these Terms.

9. Third-party services and links

The Services rely on and may link to third parties (including Razorpay, Calendly, email delivery providers, hosting, and analytics providers). We do not control and are not responsible for third-party services, their availability, or their acts or omissions. Your dealings with them are solely between you and that third party.

10. Acceptable use

You agree not to misuse the Services, including by: attempting to gain unauthorised access; interfering with or disrupting the site; scraping or bulk-downloading content; reverse-engineering; infringing others’ rights; or using the Services unlawfully. We may suspend or terminate your access at any time, without notice, for any breach.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Services and all content are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the Services will be uninterrupted, error-free, secure, or current. We make no warranty that any information is complete, accurate, or up to date, or that using the Services will lead to any particular result.

12. Limitation of liability

To the maximum extent permitted by applicable law, Mastersmith and its founder, operators, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of admission, offers, scholarships, funding, opportunities, profits, savings, data, goodwill, or reputation, arising out of or relating to your use of (or inability to use) the Services, any content, any decision by any institution, or any third-party service — even if we have been advised of the possibility of such damages, and regardless of the legal theory.

Where liability cannot be excluded, our total aggregate liability to you for all claims arising out of or relating to the Services is limited to the greater of (a) the amount you actually paid to Mastersmith for the specific product or session giving rise to the claim in the three (3) months before the event, or (b) INR 1,000. Nothing in these Terms excludes liability that cannot lawfully be excluded.

13. Indemnification

You agree to indemnify, defend, and hold harmless Mastersmith and its founder, operators, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your use of the Services, your applications or submissions, your breach of these Terms, or your violation of any law or third-party right.

14. Changes to the Services and Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms; the “Last updated” date shows when. Continued use after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the Services.

15. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to any non-waivable rights you have as a consumer, the courts of India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.

16. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be modified to the minimum extent necessary. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Services and supersede any prior understanding.
